1. Seller Identity

These Terms and Conditions of Sale (hereinafter “TOS”) apply to all sales concluded via the website http://www.noirsdessins.com, operated by:

(hereinafter “the Seller”).

2. Products

The Site offers for sale:

• Original, unique artworks, signed and accompanied by a certificate of authenticity,

• Limited edition art prints, numbered, signed, and accompanied by a certificate of authenticity,

• Derivative products (prints, stationery) created from original artworks.

Each product is described as accurately as possible on the Site. However, visuals and photographs are non-contractual and may slightly differ from the actual product.

3. Prices

Prices are expressed in euros (€), including all taxes (TTC), excluding delivery fees.
Customs duties and local taxes may apply in some countries internationally; these remain the responsibility of the Customer.
The Seller reserves the right to modify prices at any time, but the price applied will be the one in effect at the time of the order.

4. Order

The Customer selects products, adds them to the cart, and confirms the order after unconditionally accepting these TOS.
The order is confirmed by email once payment has been received.
The Seller reserves the right to cancel any order in case of non-payment or previous disputes.

5. Payment

Payment is made online securely, by:

• Credit card (Visa, Mastercard, etc.),

• PayPal.

Payment must be made in full before shipment.

6. Delivery

• Products are shipped to France and internationally.

• Original artworks and art prints are carefully packaged and shipped with tracking and insurance.

• Delivery times are indicative and may vary depending on the destination and customs procedures.

• In case of damage upon receipt, the Customer must file a claim with the carrier and inform the Seller within 48 hours.

7. Right of Withdrawal

In accordance with Article L221-18 of the French Consumer Code, the Customer has 14 days to exercise the right of withdrawal, except for legal exceptions.

Exceptions:

• Original artworks and limited edition prints (numbered and signed) are not eligible for withdrawal, as they are considered unique and personalized goods (Article L221-28 of the French Consumer Code).

• Standard derivative products can be returned in their original packaging and in perfect condition, at the Customer’s expense.

Refunds will be made within a maximum of 14 days after receipt of the return.

8. Warranties
The Seller is subject to legal guarantees:

• Guarantee of conformity (Articles L217-4 et seq. of the French Consumer Code),

• Guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).

9. Intellectual Property

All artworks and creations on the Site are protected by copyright.
Purchasing an artwork or derivative product does not transfer any intellectual property rights.
Any reproduction, distribution, or exploitation without written authorization is prohibited.

10. Liability

The Seller cannot be held responsible for:

• Delays or blockages related to carriers or customs services,

• Indirect damages related to the use of products,

• Cases of force majeure.

11. Personal Data

Personal data collected (name, address, email, phone number, etc.) are necessary for processing orders.
They are used only for this purpose and are never shared with third parties without consent.
The Customer has the right to access, correct, and delete their data (Data Protection Act / GDPR).

12. Applicable Law and Disputes

These TOS are governed by French law.
In case of dispute, the Customer agrees to seek an amicable solution with the Seller before any legal action.
Failing this, exclusive jurisdiction is granted to French courts.
