general terms and conditions

1. Definitions

In these Terms and Conditions of Sale (“TCS”):
– “Client”: any natural or legal person placing an order on the website https://www.noirsdessins.com;
– “Seller”: the sole proprietorship Bérénice Tulliez EI (Noirs Dessins), contact : noirsdessins.art@gmail.com
– “Product”: any original artwork, limited edition fine art print, or derivative product offered for sale by the Seller;
– “Order”: any validation by the Client of the online purchase process with accepted payment.

2. Scope of Application

These TCS apply to all sales made through the website https://www.noirsdessins.com between the Seller and a Client.
Validation of an order by the Client constitutes full and unconditional acceptance of these TCS.
The Seller reserves the right to modify the TCS at any time. The applicable version is the one in force on the date of the Client’s order.

3. Seller’s Identity

These Terms and Conditions of Sale apply to all transactions made via the website https://www.noirsdessins.com, operated by:

(hereinafter “the Seller”).

4. Products

The Website offers for sale:

• Original, unique artworks, signed and accompanied by a certificate of authenticity;

• Limited edition fine art prints, numbered, signed, and accompanied by a certificate of authenticity;

• Derivative products (prints, stationery) created from original artworks.

Each product is described as accurately as possible on the Website. However, visuals and photographs are non-contractual and may differ slightly from the actual product. Exact colors and dimensions cannot be guaranteed.
Offers are valid while stocks last. The Seller reserves the right to refuse any order in the event of stock unavailability or payment issues.

5. Prices

Prices are expressed in euros (€), excluding taxes (VAT not applicable, article 293 B of the French General Tax Code) and excluding delivery fees.
Customs duties and local taxes may apply in certain countries and remain the responsibility of the Client.
The Seller reserves the right to modify prices at any time, but the price applied will be the one in effect at the time of the order.

6. Orders

The Client selects the desired products, adds them to the shopping cart, and validates the order after accepting these TCS without reservation.
An order confirmation is sent by email once payment has been received.
The Seller reserves the right to cancel any order in case of non-payment or prior dispute with the Client.

7. Payment

Payment is made securely online by:

• Credit or debit card via Stripe (Visa, Mastercard, etc.).

Full payment is required before shipment.

8. Delivery

Products are shipped within France and internationally, subject to applicable legal, regulatory, or customs restrictions in certain countries.
Original artworks and fine art prints are carefully packaged and shipped with tracking and insurance.
Delivery times are indicative and may vary depending on the destination and customs procedures.
In case of damage upon receipt, the Client must file a claim with the carrier and notify the Seller within 48 hours.

9. Right of Withdrawal

In accordance with Article L221-18 of the French Consumer Code, the Client has 14 days to exercise the right of withdrawal, except where legal exceptions apply.

Exceptions:

• Original artworks and limited edition prints (numbered and signed) are excluded from the right of withdrawal, as they are considered unique and customized items (Article L221-28 of the French Consumer Code).

• Standard derivative products may be returned in their original packaging and in perfect condition, at the Client’s expense.
  Refunds will be processed within a maximum of 14 days after receipt of the returned item.

10. Warranties

The Seller is bound by the following legal warranties:

• Warranty of conformity (Articles L217-4 et seq. of the French Consumer Code),

• Warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).

11. Intellectual Property

All artworks and creations featured on the Website are protected by copyright.
The purchase of an artwork or derivative product does not entail any transfer of intellectual property rights.
Any reproduction, distribution, or use without prior written authorization is strictly prohibited.

12. Liability

The Seller cannot be held liable for:

• Delays or blockages caused by carriers or customs services;

• Indirect damages resulting from product use;

• Cases of force majeure.

13. Personal Data

Personal data collected (name, address, email, phone number, etc.) are necessary for order processing.
They are used solely for this purpose and are never shared with third parties without consent.
The Client has the right to access, rectify, and delete their data in accordance with the French Data Protection Law and GDPR.

14. Governing Law and Disputes

These TCS are governed by French law.
In the event of a dispute, the Client agrees to seek an amicable solution with the Seller before initiating legal action.
Failing that, exclusive jurisdiction is granted to the French courts.
